By downloading, installing, or using SwingFeed ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
SwingFeed is a mobile application that allows users to record, analyze, and share golf swing videos. Features include video recording with pose detection, drawing tools, slow-motion playback, GPS course yardages, and social sharing capabilities.
SwingFeed offers both free and paid subscription tiers. See Section 6 (Subscriptions) for details.
To use certain features, you must create an account. You are responsible for:

SwingFeed offers the following subscription plans:
Prices are in US dollars and may vary by region. The actual price charged will be displayed in your local currency before purchase.
Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price for your selected plan.
You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of your current billing period — you will retain access to paid features until then. No refunds are provided for partial billing periods.
If a free trial is offered, it will be clearly stated at the time of purchase. If you do not cancel before the trial ends, your subscription will automatically begin and your Apple ID account will be charged.
We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will apply to the next billing cycle after the change. You will have the opportunity to cancel before the new price takes effect.
Features labeled as "beta" are experimental and may be modified, improved, or removed. We strive to provide consistent access to all advertised features but cannot guarantee uninterrupted availability of any specific feature.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
The App, including its design, features, and content (excluding user content), is owned by SwingFeed and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.
The App is provided "as is" without warranties of any kind. SwingFeed does not guarantee that:
SwingFeed is not a substitute for professional golf instruction.
To the maximum extent permitted by law, SwingFeed shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time through the App settings.
We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms.
The following terms apply to your use of SwingFeed when downloaded from the Apple App Store.
You acknowledge that this agreement is between you and SwingFeed only, and not with Apple Inc. ("Apple"). SwingFeed, not Apple, is solely responsible for the App and its content. This agreement may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
SwingFeed is solely responsible for providing maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are SwingFeed's sole responsibility.
You acknowledge that SwingFeed, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, SwingFeed, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You agree to comply with applicable third-party terms of agreement when using the App, including your wireless data service agreement.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
